good day mam/sir. i would like to ask to ask for advice about a tax declared property named after my late father. the property was lend to my aunt for the purpose of setting up a small business in the year 1990’s for additional income she first built a barong barong to stay while she is minding her business. as years pass by, one of her children (one biological -male and one adopted-female) married a guy ( a seaman). having been well-off she started building structures in the property in last quarter of 2023. but she was questioned by the municipal officers about the constructions permit that she does not have. so she started to chat in my wife’s messenger using my aunt as alibi if i am going to sell the property because my aunt knows that my parents gave to me that piece of land. though i agree and set a price, she proposed that she will take care of the paper works even though she does not know where my other siblings are. when it was taking her a long time to process the the transaction i said to her that i changed my mind but i was informed that by my other cousins and aunt in our barrio that
she already started constructing and spreading the news that she already bought the land but it was not. she now beg from me to give her an authorization letter that she will show to the municipal officers that i allow her to make repairs/renovations and room extension. she was very respectful to me when she was asking for an authorization letter and said that they will transfer to a new place within 3 to five years. before i gave here an authorization letter i told her that she will pay me rent of 40k pesos in full for 5 years. and she agreed and that she will send the money immediately after she delivered the authorization letter to the municipal officers. She did send me first 20k (april) then after 1 month 5k and promised me that she will send me the balance on september 2024. but september came and no other payment. so i decided that this person is full of alibis and there is no use to transact with her. so i decided to terminate our verbal contract. told her personally when i visited her in our province that i am going to take the land after maybe 5 years. after 5 months i returned i return to our province for her to sign papers that the land will be returned to me after 4 years. indicated on that letter that she will demolished all structures that she built without any demolition debris at her expense. but she transformed from the begging person to a very aggressive person and keep shouting at me for different reasons. i am therefore seeking advice because the barangay captain in our barrio and he said that we have bring this matter to court because he can not decide which to side for he knows my aunt and family members and i belong to the same blood. please advice. thanks.
