  1. Michael Camasura says:

    Dear Sir / Madame;
    Good day everyone, I Mr. Michael S. Camasura, previously residing at municipality of Argao Cebu and I am current working outside country as OFW, Where it is too far for me to settle down the misdebt we had made in car loans, actually it was like this, at pandemic time I was struggle for payments, I missed more the 3 months payments, as I still can’t recover to pay the debt so we decided to do voluntary surrender of the unit to the lender while it is still fresh to avoid repossessions, it was happen three times, but still they don’t like to accept, and no offer for voluntary contract termination, the unit was still on standby, ready to return for someone from the lender will come to take it on their custody, but no one come and claim, we still try to convinced them to take it, but still they don’t want to accept, instead of accepting, they advice to sell it by auctions, but there is no auction happens by their guidance to get good price, It return it is all our effort to sell it, and give the sold out money to them to reduce the debt, and try to convince them to make it even since we already paid more than half of the amount as per contract stated, but still they don’t like to accept, Question, how we sold it out by our own effort, we did claim new registration copy on LTO and there we found that the car was not in mortgage but we had ask and paid for mortgage and they don’t inform us that they don’t file mortgage for it, as far as I know that is a ground for lenders, so car was sold, sold money was given to them, and I remember at pandemic time there was a government order, to pause the payment of those who had debt, hence it was a difficult time to everyone to pay debt, but still they count it and have penalties of the penalties to penalties, My question is, can I file complaint against them by failure to inform the borrower, failure to do mortgage of the car where we did pay for mortgage, and is there any overpricing or miscalculation happen, what complaint I can file against them and what any more complaint I can file as many possible complaint much better, and what lawyer should I seek for to win the case, any lawyer suggestion please, to whom who can handle the case probably at municipality of hilongos or bato leyte, terms and conditions for lawyers who can make it win will be discussed personally, I am not really after for money but I am looking forward to win and settle the case by their failures and grounds and to make it a lessons too on them, and Is there any grounds that lead them to closure.
    Thanks a lot for the time, I hope and I wish I could have reply from you soon.

    Michael
