Calapar Servicers, Inc. has just recently found out that according to Article 94 of the Labor Code and as explicitly explained in the B. Coverage #6 Handbook of Worker’s Statutory Monetary Benefit states that Holiday Pay may not be paid to Field Personnel whose time and performance is unsupervised by the employer.

We are a meter reading contractor of Meralco whose main job is to read and relay all collected datas/infomation to Meralco at the end of each reading day. Every morning, meter readers can go directly from home to their assigned route to read and record meralco meter movements. After reading all meters assigned to them regardless how many hours they were able to read all meters assigned to them (assigned reading itinerary may take 3 to 6 hours depending on the readers’ experience and ability). In view of the above stated facts, we can say that our meter readers are indeed FIELD PERSONNEL AND ARE UNSUPERVISED. Now, the only thing that may challenge the company’s position on holiday pay exception as stated in Article 94 is that the company has been paying these field personnel holiday pay ever since. My question is, if we stop paying holiday pay to our meter readers who are field personnel, can they invoke NON DIMINUTION OF BENEFITS? We really need your expert advice on this. Thank you.
